Criminal law in shareholder disputes

Civil law disputes sometimes escalate into criminal charges.

Within a company or group of companies, there are sometimes bitter disputes between those responsible. Unpleasant managing directors are dismissed without notice and reported, shareholders are excluded and board members are dismissed. This is not only a tough battle, but in some cases anything but fair. If there is a suspicion that exonerating documents have disappeared or been falsified and untrue allegations have been made about the persons concerned, the previously civil dispute escalates into criminal charges.

In such cases, we offer our clients criminal law flank protection: we defend against unjustified criminal charges and consistently involve the criminal prosecution authorities in cases of attempted trial fraud. Across various proceedings and investigations in Germany and abroad, we compare the results of evidence, secure and evaluate statements by the parties involved, record contradictions and twists and turns in the clarification of the facts. We conduct our own research and, if necessary, commission expert third parties to carry out investigations. In this way, we take fair but decisive measures to ensure that the party we represent does not lose its legal position through dishonest conduct of the proceedings.
